Terms of Sale

These terms apply to every purchase of LaunchKit made through launchasaas.dev. By completing checkout you agree to them, and to the commercial license that governs the code itself (summarised at /license; the executed text ships as LICENSE in each repository).

1. What you are buying

A one-time, non-transferable commercial license to the LaunchKit source code — two repositories, launchkit-api and launchkit-web — delivered as read access to a private GitHub organization. This is not a subscription: there are no recurring charges and nothing to cancel. The tier you choose (Solo or Unlimited) sets how many products you may build with it and which support channels are included; the code itself, the repository access and the update stream are the same on both.

2. Payment

Payment is processed by Stripe, our payment processor. We never see or store your card details. Prices are shown in US dollars and, where required by law, Stripe adds and collects applicable VAT, GST or sales tax at checkout. You will receive a receipt and, if enabled, an invoice by email.

3. Delivery and access

Within minutes of a successful payment you receive an email with a claim link. Enter your GitHub username there and we invite that account to the private organization. Access is personal to you: keep your GitHub account secure, and don't share organization access with third parties. If you need to move your license to a different GitHub account, email us.

4. Refunds

Because the product is source code, we cannot take it back once it has been delivered. Refunds are therefore available only before you claim access: if you change your mind, email us within 7 days of checkout and we refund in full. Once you have been invited to the private organization, all sales are final. Read the FAQ and email us with questions before buying — we answer every message.

5. Updates and support

Both tiers receive new releases for as long as LaunchKit is maintained, with no renewal and no expiry, plus email support. Unlimited adds the private Discord, early access to new features and a vote on the roadmap. Security fixes go to every license holder regardless of tier. We don't promise a specific release cadence or that any particular feature will be built.

6. Intellectual property

LaunchKit and its source code remain our property; you receive a license, not ownership. Everything you build on top of it is yours — you may sell, host and modify your applications without restriction and without crediting us. The codebase includes third-party open source components under their own licenses (MIT, BSD and similar); those terms apply to those components.

7. What you may not do

You may not resell, sublicense or redistribute the boilerplate itself — as a starter kit, template, code generator or competing product — or publish the source code as-is. You may not share your organization access, and you may not remove proprietary notices from any redistribution. The full list of permissions and restrictions is in the license.

8. Termination

If you breach the license — for example by redistributing the code or sharing access — we may remove you from the private organization and terminate your right to receive updates and support. The license terms continue to govern any copies of the code you already hold.

9. Disclaimer of warranties

The software is provided as is, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it is error-free, that it meets any regulatory requirement, or that it will be maintained for any particular period.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business, arising from your purchase or use of the software. Our total liability under these terms and the license is limited to the amount you paid for it.

11. Changes to these terms

We may update these terms for future purchases. Changes that affect existing license holders — for example to the support terms — will be communicated by email at least 14 days before they take effect.

12. Governing law

These terms are governed by the laws of the jurisdiction where the seller is registered. Any dispute arising from a purchase will be resolved in the courts of the jurisdiction where the seller is registered.
